Thanks for playing Tales of Elatora. These Terms of Service ("Terms") are an agreement between you and Tales of Elatora ("we," "us," or "our") covering your access to and use of the Tales of Elatora mobile game (the "Game"). Please read them before you start playing.
By creating an account, downloading, or using the Game, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Game.
You create an account with an email address and password. You are responsible for keeping your login credentials confidential and for all activity under your account. Please provide accurate information and keep it current.
If you believe someone has accessed your account without permission, contact us right away at the email below. You can delete your account at any time from Settings in the Game. See our Privacy Policy for what account deletion removes and what may be retained.
The Game includes virtual currency (such as gems and gold) and virtual items (such as equipment and consumables) that exist only inside the Game.
Virtual currency and virtual items have no real-world monetary value. They cannot be redeemed, exchanged, or cashed out for real money, and they cannot be sold, traded, gifted, or transferred outside the Game. The Game may let you exchange one form of virtual currency for another inside the Game, for example trading gold for gems, and those rates can change at any time.
We may add, remove, modify, rebalance, or discontinue any virtual currency, item, or feature at any time, including ones you have already obtained.
Gems can be purchased with real money through the Apple App Store or Google Play. Those purchases are billed and processed entirely by Apple or Google, and we never see or store your payment details. All purchases are final and non-refundable, except where required by Apple's or Google's own refund policy or by applicable law. If a purchase is refunded or reversed, including a chargeback, we may deduct the associated virtual currency or items from your account, even if they have already been spent.
To keep the Game fair for everyone, you agree not to cheat, exploit bugs, use modified game clients, bots, scripts, or other automation, interfere with our servers, or buy, sell, trade, or share accounts.
If we reasonably determine that you have violated this section, we may warn you, remove improperly obtained progress, currency, or items, or suspend or terminate your account, without a refund.
Tales of Elatora is an evolving game. We may add, change, rebalance, or remove features and content at any time, and we may reset characters or progress during beta or other test periods.
We do not guarantee that the Game will always be available or error-free, and we may suspend or shut down all or part of it at any time. We will try to give notice before a permanent shutdown where we reasonably can.
The Game, including its code, art, music, writing, lore, and design, is owned by us and protected by copyright and other intellectual property laws. These Terms give you only a limited, personal, non-transferable license to play the Game for your own non-commercial use.
When you choose a character or account name, you give us a royalty-free license to display and use that name within the Game and related promotional materials, for example in a leaderboard. Please don't choose a name that is offensive, impersonates someone else, or infringes someone else's rights. We may change, remove, or reject a name, and may suspend accounts that misuse this feature.
The Game does not currently include chat or other free-form communication between players.
You may stop using the Game and delete your account at any time. We may suspend or terminate your access if we reasonably believe you have violated these Terms or for other legitimate business reasons. Sections that by their nature should continue after termination, including content ownership, disclaimers, and limitation of liability, will survive.
The Game is provided "as is" and "as available," without warranties of any kind, express or implied. We do not guarantee that the Game will be error-free, secure, or available at all times, or that any particular content, feature, or virtual item will remain available.
To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, progress, virtual currency, or virtual items, arising from your use of the Game. Our total liability to you for any claim relating to the Game will not exceed the amount you paid us, if any, in the 12 months before the claim arose. Nothing in these Terms limits any liability that cannot be limited under applicable law.
We may update these Terms from time to time. If we make a material change, we will update the "Last updated" date at the top of this page. Continuing to use the Game after a change takes effect means you accept the updated Terms.
