Such risks include without limitation: defective vehicles or equipment; mechanical failure; inadequate safety equipment or training; collision with other vehicles or equipment or immovable structures; unsafe terrain; inadequate rescue or medical attention; my own physical or mental condition, or my own unfamiliarity with the Activities; or other causes. I understand that such risks simply cannot be eliminated without jeopardizing the essential qualities of the Activity; that Releasees sub-contractors have difficult jobs to perform; that they seek safety but are not infallible; that they might be unaware of a participant\'s fitness or abilities; that they may give incomplete warnings or instructions; and that the equipment being used might malfunction.\\n\\nI also agree that I, my spouse, my domestic partner, my children, my parents, my heirs, assignees, personal representatives, legal representatives and estate will not make a claim against, sue, or attach the property of any Releasee in connection with any of the matters covered by the Agreement.\\n\\nI expressly agree and accept and assume all of the risks existing in this Activity. My participation in this Activity is purely voluntary, and I elect to participate in spite of the risks.\\n\\nI hereby voluntarily release, forever discharge, and agree to indemnify and hold harmless Releasees from any and all claims, demands, or causes of action, which are in any way connected with my participation in this Activity or my use of vehicles or equipment, including any such claims which allege negligent acts or omissions of Releasees.\\n\\nI grant the Releasees a perpetual, royalty-free sub-licensable right for any use or purpose to record or take pictures of me participating in the Activity, modify any such pictures or pictures I may submit the Releasees and use my name with such recordings or pictures.\\n\\nReleasees or anyone acting on their behalf, be required to incur attorney\'s fees and costs to enforce this agreement, I agree to indemnify and hold them harmless for all such fees and costs.\\n\\nI certify that I have adequate insurance to cover any injury or damage I may cause or suffer while participating, or else I agree to bear the costs of such injury or damage myself. I further certify that I am willing to assume the risk of any medical or physical condition I may have.\\n\\nIn the event that I file a lawsuit against Releasees, I agree to do so solely in the state of California, and I further agree that the substantive law of that state shall apply in that action without regard to the conflict of law rules of that state. I agree that if any portion of this Agreement is found to be void or unenforceable, the remaining portions shall remain in full force and effect.\\n\\nI acknowledge: `(a)` that I have reviewed this Agreement, and that I understand and agree to its terms; `(b)` that I have been given the opportunity to discuss the provisions of this Agreement with legal counsel, and that I have either had such discussions or voluntarily and knowingly chosen not to do so; and `(c)` that I have been given the right to object to and bargain regarding any of these provisions, but have voluntarily and knowingly chosen not to do so. **I am freely and voluntarily signing this Agreement and intend that my signature be the complete and unconditional release of all liability to the greatest extent allowed by law.**\\n\\n**I acknowledge and expressly waive the rights and benefits of Section 1542 of the California Civil Code which reads as follows: \\\"A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.\\\"**\\n\\nBy signing this document, I acknowledge that if anyone is hurt or property is damaged during my participation in this Activity, I may be found by a court of law to have waived my right to maintain a lawsuit against Releasees on the basis of any claim from which I have released Releasees herein.
